Florida Police Refuse to Make Arrest After Man Shoots into Instacart Driver’s Car

Police in Davie, Fl, about 25 miles north of Miami, have elected not to charge the man who shot into a grocery delivery driver’s car, stating that the man felt “threatened” when the car pulled into his driveway by mistake after being given the wrong delivery address. 

On April 15h, Waldes Thomas Jr., 19, a driver for Instacart, and his girlfriend Diamond D’arville, 18, were attempting to deliver groceries in a dimly lit area. They were on the phone with the customer, who had accidentally provided them with the wrong address.

According to the report filed with Davie PD, the two then turned onto the property of Antonio Caccavale, who claims that he told his son to instruct them to leave immediately. After claims by his son that the car was driving erratically, Caccavale says that he fired off multiple shots aimed at the tires. He also claims that the vehicle drove over his foot before he started shooting. 

Thomas and D’arville told police that they “attempted to reverse out of the area,” but the car collided with a rock. Caccavale then approached them and reportedly grabbed onto the driver door window. 

Thomas says he immediately tried to leave the area and heard three close gunshots.

Davie PD says that they elected not to file charges, as “each party appear justified in their actions based on the circumstances they perceived.”

But Harold Pryor, Broward County State Attorney, told ABC News in a statement that his office’s prosecutors will be the final decision on whether charges should be filed and that he has ordered an investigation into the incident. According to Pryor, the police department closed the case without consulting the state attorney’s office. 

Though they declined to comment, Davie PD released the lead detective’s report.
